Family Law cases are cases arising from the private living spaces of individuals; It is aimed by the Procedural Law to continue these lawsuits in line with the sensitivities of the parties, by minimizing the wearing and destructive effects of the process, and not leaving a traumatic effect on their ongoing lives.

Disputes arising from matters within the scope of family law can be resolved within separate types of cases. Some issues related to family law can be settled temporarily as a precaution while the disputes are adjudicated. For example, in a divorce case, joint custody of the child can be given to one of the parties as a precautionary measure as long as the divorce case continues. Again, during the divorce case, which of the parties will use the family residence, can be resolved temporarily by assigning the family residence to one of the parties. Apart from this, the alimony paid by the party with good economic status to the party whose expected benefit will be damaged by divorce can be ruled by precaution during the trial.

Divorce cases can be conducted in the form of an uncontested divorce if the parties agree on the terms of the divorce. If the parties cannot agree on the terms of the divorce or if one of the parties does not want to divorce, do not judge; It continues as a contested divorce case.

Although the provisions of alimony can be determined by the decision made as a result of the divorce case, they can also be taken into consideration as a precautionary measure during the trial phase. Alimony paid by the person whose economic situation is good to the party whose current and expected benefit will be damaged by divorce can be ruled together with the divorce decision as poverty alimony. Likewise, alimony paid for joint children appears as participation alimony. Both alimony can be judged as a precautionary measure while the trial continues.

Since custody and related cases are of public order, it emerges as an institution that is established by considering the joint child or children’s best interests, rather than the will of the parties, while the marriage union continues or along with the divorce. As a result of this, the establishment of a personal relationship between the parent and the joint child who does not have custody is also governed by taking into account the best interests of the joint child, namely the physical, psychological, economic and social development of that child.

Claims for pecuniary and non-pecuniary damages within the scope of family law, claims arising from property regimes and requests for jewelry can be seen together with divorce cases, or they can be demanded in a separate lawsuit after the divorce proceedings are over.
